All Accused in Deaths of 10 Elderly from COVID-19 in Buenos Aires Acquitted

A Buenos Aires appeals court has acquitted all defendants, including the nursing home owners, in connection with the deaths of 10 elderly residents from COVID-19. The defense attorney announced the overturning of the guilty verdict, while the victims' relatives are considering an appeal to the city's Supreme Court.

All individuals accused in the deaths of 10 adults from coronavirus at the Apart Los Incas nursing home, located in the Buenos Aires neighborhood of Belgrano, have been acquitted by a ruling from the Buenos Aires City Court of Appeals. Rafael Cúneo Libarona, the lawyer, in an interview with the Argentine News Agency (NA), stated: 'The prosecutor requested the case be elevated to trial; during the oral hearing, a majority convicted my client. One of the judges called for acquittal, while two did not. I appealed to the city's cassation court, which overturned the guilty verdict, acquitted all the accused, and dismissed the financial claims.' Meanwhile, sources close to the case's accusers informed this medium that 'the only option is to go to the Buenos Aires City Court,' although this is a measure still under evaluation. Those accused were the owners of the facility: Luis Daniel Megyes, Hugo Visca, and Carla Raffo, facing charges of aggravated culpable homicide and violation of health measures during a pandemic, in addition to culpable injuries and multiple failures in resident care. Throughout the hearings, various proofs were presented demonstrating irregularities in inspections conducted between 2017 and 2020 at Geriátrico Apart Incas S.A., yet the facility was not closed, which could have prevented the infections.
